Terms of Service

1. Acceptance of Terms
By accessing or using Absterco Pay ("the Service"), you agree to be bound by these Terms of Service and all applicable laws. If you do not agree, you must not use the Service. These terms apply to the organisation that has entered into a service agreement with Absterco (Pvt) Ltd and its authorised users.
2. Description of Service
Absterco Pay is a payment infrastructure platform that enables organisations to accept one-time and recurring card payments by abstracting the Mastercard Payment Gateway (Seylan Bank acquirer). We provide API access, a management dashboard, and webhook delivery as part of the Service.
3. Eligibility and Account Responsibilities
- You must be a registered business entity to use Absterco Pay. Consumer use is not permitted.
- You are responsible for maintaining the confidentiality of your API keys and dashboard credentials.
- You must immediately notify us at info@absterco.com of any unauthorised access.
- You are responsible for all activity that occurs under your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, or prohibited purpose.
- Process payments for goods or services that violate applicable laws of Sri Lanka or the cardholder's jurisdiction.
- Attempt to circumvent rate limits, security controls, or access restrictions.
- Reverse-engineer, decompile, or extract the platform's source code.
- Resell, sublicence, or white-label the Service without prior written consent.
5. Fees and Billing
Fees are governed by your signed service agreement with Absterco. Commission rates and gateway fees are disclosed at the time of each transaction and locked at charge time. Absterco reserves the right to update fee structures with 30 days' written notice.
6. Settlement
Settlement of net amounts (after gateway fees and Absterco commissions) is performed according to the settlement schedule in your service agreement. Absterco is not a bank and does not hold client funds beyond the settlement cycle.
7. Suspension and Termination
Absterco may suspend or terminate your access immediately if we reasonably believe you are in breach of these Terms, engaging in fraudulent activity, or posing a risk to the platform or other clients. We will endeavour to provide notice where legally permitted.
8. Limitation of Liability
To the maximum extent permitted by law, Absterco (Pvt) Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of revenue, loss of data, or business interruption. Our total liability shall not exceed the fees paid by you in the three months preceding the claim.
9. Governing Law
These Terms are governed by the laws of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated with at least 14 days' notice. Continued use of the Service after changes take effect constitutes acceptance.
